When a sanction arrives in your mailbox (physical or virtual), you have two options: assume the facts and pay the corresponding amount or claim. If you opt for the first route, in most cases, they will only have to pay half… and in some of them you can even request a refund. The DGT explains how you can request a refund of a fine that you have already paid.

This process can only be carried out in certain cases: you can only request that refund If you identify any anomaly or incidence in the payment which, in addition, has to be subject to claim. What situations are we talking about? Of a duplicity in the payment, when the amount paid does not coincide with that of the sanction or, according to the DGT, in any other type of situation.

To this we must add another requirement: You can only request a refund if the sanction is from the DGT. Before starting the whole process, check who has fined you: to pay, claim or make any claim, you always have to go to the body that has fined you.

What do you need?

Submitting a claim in which you request a refund: for this you need the application form for refund of fees or penalties, proof of payment of the fine with the sanctioning file number (for cases of duplicity of payment and for cases in which the person who has made the payment of the sanction is different from the one sanctioned) or a copy of the resolution of the appeal or claim (if this is the cause).

How can you request a refund?

To ask the DGT for a refund of a fine that has already been paid, you have two options: Do it in person at any Headquarters or Traffic Office or do it online. In the first case, you must deliver all the documentation at the information or incident window and you can do so without making an appointment.

In the second you will have to do it through the Electronic record and for this, you need the electronic DNI or the electronic certificate in force or your Cl@ve credentials to be able to access. To this we must add the AutoFirma program because you must sign the presentation of your writing.

Who can ask for it?

The headline of the sanction, the person who has made the payment of the penalty if it is not the sanctioned party (remember that, in this case, the payer’s ID must appear on the payment receipt) or a third person other than the above, who, yes, has been authorized by the sanctioned party through the Registry of Empowerments of the DGT.

When will the DGT pay you back?

Traffic explains that there is no fixed term, although, as a guideline, it speaks of a maximum period of six months. It must also be taken into account that they will review both the sanction file and the documentation provided to return the correct amount: this may be higher or lower than the amount requested. And the refund will always be made in the current account indicated by the person who carries out the process.
